YAMAHA RACING CONTEST

BROUGHT TO YOU BY INDIA YAMAHA MOTOR PVT LTD

1. The “Yamaha Predict & Win Contest” (“Contest”) is a limited-period promotional activity conducted by India Yamaha Motor Pvt. Ltd. (“Yamaha”) and is valid from 16th May 2025 to 17th November 2025. Participation is open exclusively to resident Indian citizens, excluding residents of the State of Tamil Nadu, pursuant to the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
2. Employees of Yamaha, its affiliates, representatives, and their immediate family members are ineligible to participate. Additionally, foreign nationals residing in India and Non-Resident Indians (NRIs) are not eligible to enter the Contest.
3. Participation in the Contest shall be deemed to constitute an acknowledgment and acceptance of these Terms & Conditions, and participants agree to be bound by the same.
4. All content and material relating to the Contest are the sole property of India Yamaha Motor Pvt. Ltd.
5. There is no entry fee required for participation in the Contest.
6. By entering the Contest, participants represent, warrant, and undertake that:
   • Their participation does not breach any applicable law, agreement, or obligation;
   • They shall comply at all times with applicable laws and Yamaha’s internal policies, including but not limited to:
   • Anti-Corruption and Anti-Bribery Laws; and
   • Yamaha's Privacy Policy;
   • All information provided by them:
   • Is accurate and complete;
   • Is not misleading or deceptive and does not infringe any third-party rights;
   • Complies with all applicable laws.
7. Yamaha reserves the right to verify the eligibility and identity of any participant at any stage of the Contest. Failure to provide such verification or if found ineligible under these Terms & Conditions, the participant shall be disqualified at Yamaha’s sole discretion.
8. Yamaha shall determine the winners in its sole discretion. From each race, 20 winners who make accurate predictions shall be awarded Yamaha merchandise. One lucky winner from reach race will be awarded replica of Fabio Quartararo’s helmet through lucky draw.
9. Yamaha shall not be responsible for any entries that are lost, late, incomplete, corrupted, or not received due to technical failures or any other errors of any kind. Yamaha shall not be liable for any delay or failure to comply with its obligations under the Contest if such delay or failure arises from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, pandemic, or governmental action.
10. Yamaha reserves the right to disqualify any participant who tampers with or attempts to tamper with the Contest entry process or violates the spirit of the Contest. Any use of automated systems or bulk entries is prohibited and will result in disqualification.
11. Gratification: Yamaha merchandise shall be provided to participants based on entries submitted through the official contest website.
12. By submitting an entry, each participant affirms compliance with these Terms & Conditions and acknowledges that Yamaha may, at its sole discretion, disqualify any entry that violates these provisions.
13. By entering the Contest, each participant agrees to indemnify, defend, and hold harmless Yamaha, its parent company, affiliates, subsidiaries, directors, officers, employees, agents, and representatives from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
    • any breach or alleged breach by the participant of these Terms & Conditions;
    • any violation of applicable law, regulation, or third-party rights (including intellectual property rights); or
    • any misrepresentation or fraudulent act by the participant in connection with the Contest.
14. By participating, the participant agrees to release and hold harmless Yamaha, its parent company, affiliates, subsidiaries, directors, officers, representatives, agents, and employees from and against any claims, damages, losses, or liabilities arising directly or indirectly from:
    • Receipt, use, or misuse of any prize awarded under this Contest; or
    • Participation in any Contest-related activities, including travel to or from such activities.
15. By participating in the Contest, each participant expressly consents to Yamaha’s collection, storage, processing, and use of personal data submitted for the purposes of administering the Contest and for Yamaha’s internal record-keeping and promotional activities, in accordance with its Privacy Policy.
16. Each eligible person may register and participate in the Contest through Yamaha’s official Predict & Win Contest website. One entry per race per participant shall be permitted.
17. Prizes must be claimed, and any documentation formalities must be completed, within 30 days from the announcement of winners. Failure to do so may result in forfeiture of the prize at Yamaha’s sole discretion.
18. The results shall be announced exclusively on Yamaha’s official Instagram & Facebook page and Website.
19. The decisions of Yamaha’s jury shall be final and binding. Winners must provide valid proof of identity, such as a passport, driver’s license, voter ID, PAN card, or student ID, as applicable.
20. All information provided by Yamaha to participants shall be treated as confidential and shall not be disclosed without Yamaha’s prior written consent, except as required by law.
21. All applicable taxes, duties, and levies on prizes shall be borne solely by the winners. Yamaha shall deduct applicable taxes at the time of prize distribution.
22. Yamaha’s decision in all matters related to the Contest, including selection of winners and award of prizes, shall be final and binding on all participants.
23. Yamaha reserves the right to modify, alter, or withdraw the Contest and/or these Terms & Conditions at any time without prior notice.
24. All intellectual property rights associated with the Contest shall vest solely with Yamaha. This includes, but is not limited to, all content, images, designs, typography, visual elements, and graphics used or created in connection with the Contest.
25. By accepting a prize, each winner consents to Yamaha’s use of their name, image, likeness, voice, and statements for promotional and advertising purposes, in perpetuity, across all forms of media now known or developed in the future, without additional compensation, unless prohibited by law.
26. Any claims regarding damaged or broken prizes must be reported immediately upon receipt. No subsequent claims shall be entertained.
27. If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remainder of the provisions shall remain valid and enforceable to the fullest extent permitted by law.
28. Any failure or delay by Yamaha to enforce any of its rights under these Terms & Conditions shall not constitute a waiver of those rights or any other rights in future.
29. All disputes arising in relation to the Contest shall be subject to the exclusive jurisdiction of courts in Chennai, India.
