Yamaha Music Video Contest

1. The Contest called "Yamaha Music Video Contest" (hereinafter referred to as “Contest”) is a limited period contest valid from 14th June 2025 – 14th September 2025, brought to you by India Yamaha Motor Pvt. Ltd (hereinafter referred to as “IYM” or “Yamaha)” and it is open to Resident Citizens of India.
2. Employees of IYM its affiliates, representatives and their immediate family members are not eligible to participate in the Contest. Citizens of foreign countries residing in India and/or Non Resident Indians are not eligible to participate in the Contest.
3. The Participant agrees and accepts that he/she does not fall into the category of "influencer" as defined by Instagram and Facebook and that he/she also does not fall into the category of all types of influencers as defined by the above criteria, which are Nano Influencer, Micro Influencer, and Macro Influencer.
4. The main requirement for the Participant to enter this contest is that he or she have a public Instagram/Facebook account & public YouTube Channel that is not restricted or locked to the public.
5. The participant must read and abide by all the terms and conditions before taking part in the contest. The participation in the Contest shall imply that participant has read through and agreed to adhere to the terms and conditions and be bound by them.
6. Material pertaining to “Yamaha Music Video Contest” is the property of IYM.
7. No entry fee is charged to participate in the Contest.
8. You hereby represent and warrant that You (i) confirm that entering into this Contest and contesting the same do not violate or conflict with any laws, its constitutional documents, any other agreement it is or may be bound; (ii) shall at all times comply with all applicable laws and abide by all Yamaha’s policies and regulations, including (a) Anti-Corruption and Bribery; (b) Yamaha’s Privacy Policy; and (iii) confirm that the information provided by You (i) are accurate and complete; (ii) are not deceptive or misleading or infringes third party’s right; (iii) and are compliant with all Laws.
9. Yamaha reserves the right to verify the eligibility and identity of any participant at any stage of the Contest. Failure to provide such verification or if found ineligible under these Terms & Conditions, the participant shall be disqualified at Yamaha’s sole discretion.
10. Top 3 Winners will be decided by IYM. The entries will be judged by the Music Artist collaboration with IYM.
11. Yamaha shall not be responsible for any entries that are lost, late, incomplete, corrupted, or not received due to technical failures or any other errors of any kind. Yamaha shall not be liable for any delay or failure to comply with its obligations under the Contest if such delay or failure arises from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, pandemic, or governmental action.
12. Yamaha reserves the right to disqualify any participant who tampers with or attempts to tamper with the Contest entry process or violates the spirit of the Contest. Any use of automated systems or bulk entries is prohibited and will result in disqualification.
13. The Contestant agrees and acknowledges that no purchase or payment shall be made for increasing the number of likes or views, and that if such non-compliance comes to Yamaha's attention, such entries, as determined by Yamaha in its sole and absolute discretion, will be considered ineligible and will not be included in the Contest. Each Participant agrees that his or her entry complies with these terms and conditions by submitting an entry. Each Participant also agrees that Yamaha may disqualify them from the Contest if Yamaha believes, in its sole and absolute discretion, that an entry violates these terms and conditions.
14. By participating in this Contest, Participant agree to release and hold harmless Yamaha, each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or 2) participation in the contest or any prize related activities, including but not limited to traveling to or from any prize related activity.
15. Participant and the person adjudged as winner shall be in compliance with all applicable laws and regulations of India, including, without limitation, laws and regulations relating to corruption and bribery. It is the sole responsibility of the winner to face the consequences, and Yamaha is under no obligation to support in any way. Yamaha reserves the right to take any further action in such a circumstance, including suing the winner for damages.
16. IYM holds all the rights to select or disqualify winners in case of discrepancy.
17. By entering the Contest, each participant agrees to indemnify, defend, and hold harmless Yamaha, its parent company, affiliates, subsidiaries, directors, officers, employees, agents, and representatives from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
1. any breach or alleged breach by the participant of these Terms & Conditions;
2. any violation of applicable law, regulation, or third-party rights (including intellectual property rights); or
3. any misrepresentation or fraudulent act by the participant in connection with the Contest.
18. Every person registering on the “Yamaha Music Video Contest” Website of IYM shall be eligible to play the online Contest. Every participant shall be allowed one entry to play the online contest.
19. Winners will get a chance to win Yamaha FZ-S Fi Hybrid motorcycle.
20. Prizes not claimed / documentation formalities did not adhere to within 30 days of announcement of winners, will be forfeited by IYM in its sole and absolute discretion.
21. The winning participants shall be informed of the result on Yamaha Instagram page & on the Yamaha official website only.
22. The decision of the Yamaha Jury members will be final and binding. All winners will be required to submit proof of identity (passport, driving license, Voters ID, PAN Card, or school or college ID card). The winner/s shall be announced on Yamaha Motor India Instagram page.
23. By participating, the participant agrees to release and hold harmless Yamaha, its parent company, affiliates, subsidiaries, directors, officers, representatives, agents, and employees from and against any claims, damages, losses, or liabilities arising directly or indirectly from:
1. Receipt, use, or misuse of any prize awarded under this Contest; or
2. Participation in any Contest-related activities, including travel to or from such activities.
24. All information provided to you by Yamaha is deemed confidential and shall not be disclosed to anyone else, except as required under applicable law with prior written notice to Yamaha before disclosure of such information.
25. All taxes and other levies or charges applicable to the prizes shall be borne by the participants/winners and the same shall be deducted at the time of giving the prize.
26. Decision of IYM in all matters relating to this Contest, including draws and prizes, shall be final and binding on the participants.
27. The Courts at Chennai shall have exclusive jurisdiction in case of any dispute.
28. IYM reserves the right to vary, amend, and alter any terms of the Contest including the right to withdraw the Contest, at any time, without any notice.
29. All participants entering the Contest on the Yamaha Instagram shall be deemed to have unconditionally agreed to the terms of the Contest and all decisions of IYM in connection with this Contest.
30. Intellectual property rights involved as part of Contest shall vest in Yamaha. Also, Yamaha will retain ownership of the background used for images, typography, design content, visual effects, graphics and in all other property that was not created as part of provision of Contest.
31. By participating in the Contest, each participant expressly consents to Yamaha’s collection, storage, processing, and use of personal data submitted for the purposes of administering the Contest and for Yamaha’s internal record-keeping and promotional activities, in accordance with its Privacy Policy.
32. Notwithstanding the above, by accepting a prize, Participant consents to the use of their name, photograph and/or likeness, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast, and Internet), for all legitimate business purposes of IYM including advertising and promotional activities without additional compensation, unless prohibited by law.
33. All ancillary expenses, including but not limited to travel, accommodation, and boarding for collection of prize by winner, shall be borne solely by the winners. Yamaha shall not be liable to bear any such costs.
34. In the event the prizes are delivered in a broken or damaged condition, the same shall be reported at the time of the receipt of the same itself. No subsequent claims shall be entertained.
35. Any failure or delay by Yamaha to enforce any of its rights under these Terms & Conditions shall not constitute a waiver of those rights or any other rights in future.
36. All disputes relating to this Offer shall be subject to the exclusive jurisdiction of courts of Chennai only. Copyright (C) IYM. All rights reserved.
