This Privacy Policy (“Privacy Policy”) explains how India Yamaha Motor Private Limited (“Yamaha”, “we”, “us” or “our”) collects, uses, stores, processes and shares personal data when you use the Y-Connect R Application (“Y-Connect R”) and the related Yamaha Subscription Services (“Services”) required to access the connected features of Y-Connect R and describes the purposes for which such data is used and the safeguards applied to ensure its protection to provide owners of our motorcycles new ways to enjoy travelling on your motorcycle, connecting to your Yamaha motorcycle.

This Privacy Policy applies to data collected and processed during your use of Y-Connect R and the Services. Disclosures required under local laws are set out under country specific sections. The official language of this Privacy Policy is English.

1. Information We Collect About You

   We process the following data about you (“your data”). This may include your personal data.

   1. Data you enter directly onto Y-Connect R
   • Data you need to register to use the Y-Connect R (such as login and password details)
   2. Data obtained from your vehicle through the Y-Connect R
   • Usage history of Y-Connect R, operation log
   • Smart device data (such as device name and OS version)
   3. Data about your motorcycle connected to Y-Connect R. This includes:
   • Location information
   • Data acquired from various sensors such as vehicle acceleration information
   • Vehicle identification number, vehicle status.
    

   The data listed above is collected only for specified purposes related to the functioning and delivery of Y-Connect R and the Services and is processed using reasonable security and organizational safeguards to protect personal data against unauthorized or unlawful processing, access or disclosure.

   We collect and process only such personal data as is necessary for the purposes specified in this Privacy Policy and do not process personal data in a manner that is inconsistent with those purposes.

   You may manage or restrict certain categories of data such as location permissions through device settings, however some connected features may not function fully if permissions are disabled.

   Data retrieved through the Y-Connect R may be combined with personal information provided by you to Yamaha Group, information provided through third party, and/or information provided through our Group’s products and services and used within the scope of “3. Purpose of Use”

2. Legal Basis for Processing

   To use the Y-Connect R, you will be asked to confirm and consent to the Y-Connect R Terms and Conditions of Use and this Application Policy. Any processing of your data obtained through the Y-Connect R shall be conducted based on this consent.

   You may withdraw your consent at any time by contacting us through the channels stated in this Privacy Policy and such withdrawal may limit access to certain connected features that rely on the processing of personal data.

   Where processing is required to meet legal or contractual obligations we may continue to retain or use personal data limited to such necessity.

   We do not obtain or rely on consent through misleading design or coercive mechanisms and ensure that consent is freely provided and capable of being withdrawn.

3. Purpose of Use

   We process your data for the following purposes:

   1. To communicate with you
   • Ensure Y-Connect R is operating smoothly on your smart device
   • Respond to your inquiries, requests, and complaints
   • Offer information on contests, events, and promotions and to administer these activities
   • Share administrative information such as changes to our terms, conditions, and policies
   • Respond to your data rights requests (see “10. Your Rights”)
   2. To conduct research and development of products and features, and to improve services
   • Conduct research, and develop, promote new products and services
   • Improve and/or modify existing services and features
   • For quality and security improvement of products and services
   • Develop new features in response to customer needs
   3. To ensure our business purpose
   • Perform and provide Y-Connect R (including supplemental and related services)
   • Conduct data analytics, audits, fraud monitoring and prevention, business planning, determining effectiveness of campaigns, reporting, and forecasting
   • Gather and analyze information such as market research for the purpose of quality improvement and product development
   • Provide information on new and updated products and services related to Yamaha Motor Group for purposes including marketing and advertising by email, SMS, Y-Connect R and/or other contact details you have provided

   • Fulfill contractual obligations with third parties, agents, subsidiaries and affiliates
   • To ensure protection and safety of property and rights
   • Protect network and information asset

   Data retrieved through the Y-Connect R may be combined with information directly provided by you to Yamaha Group, information provided by a third party, and/or information you provide through our Group’s products and services. These will be used to achieve the purpose(s) of use stated above.

   We do not process personal data beyond the purposes outlined above unless separately specified and agreed.

4. Retention Period

   We will store your personal data for the period necessary to fulfill the stated purpose(s) of use (“3. Purpose of Use”) and/or as required by laws.

   Personal data that is no longer required for the stated purposes will be deleted or anonymized within a reasonable period unless retention is required under applicable laws.

   Retention timelines may vary depending on technical and regulatory requirements.

   We periodically review retained personal data to ensure that it is limited to what is necessary for ongoing lawful purposes.

5. Sharing Your Data
   1. General

   We may share your data with our subsidiaries, affiliates and counterparties (such as distributors and dealers) in India and contractors within the scope necessary to achieve the purpose of use (“3. Purpose of Use”). Regardless of the purpose of use, your data will be converted into a form where the individual is unable to be identified, and then shared with the third parties mentioned above, as statistical or aggregated data.

   Some functions utilize location information. If you use these functions, your location information may be shared to the map provider through Y-Connect R. Services we use include Google Maps provided by Google.

   2. Google's Terms and Privacy Policy

   When you navigate with Google Maps using Y-Connect R, Google collects navigation data, such as GPS location and the route you took, to improve Google Maps for everyone. This data may be used to make information, including real-time traffic conditions and disruptions, visible to others and help them find the best route. These updates to the map won't be associated with your Google Account or device. Google's Terms and Privacy Policy apply.

   Y-Connect R may also collect and use this data.  Please refer to Y-Connect R app Terms and Privacy Policy for more information.

   We do not sell or commercially trade personal data, and any sharing with third-party service providers is limited to what is necessary to operate Y-Connect R and the Services and is subject to appropriate contractual and technical safeguards.

6. Transfer of Personal Information Abroad

   As we are engaged in business activities on a global scale, we may transfer your data including personal data to a country or region that do not have personal data protection laws or regulations equivalent to the country or region you reside in or are located. When transferring your data abroad, we will take appropriate measures in accordance with provisions set forth in applicable laws and regulations.

   Cross-border data transfers will be undertaken subject to reasonable security safeguards and contractual protection to ensure continued protection of your personal data.

7. Processing of Children’s Personal Information

   This Application is not intended for individuals under 18 years of age, and we do not knowingly collect personal data relating to such individuals. If we become aware that personal data of an individual under 18 has been collected, such data will be deleted without undue delay.

8. Security

   We recognize the importance of protecting personal data. We have established a management structure to prevent unauthorized access, loss, destruction, falsification, leakage of your data. We take appropriate organizational, physical and technical security measures including:

   • Established internal policy and management structure, and conduct regular monitoring
   • Implement necessary security measures to the devices and limit access to your data only to authorized personnel
   • Restrict access, implement anti-malware measures, encrypt when transferring or receiving data
   • Include non-disclosure in internal rule and conduct regular training to officers and employees
   • Implement appropriate security measures based on the laws and regulations of the relevant countries/regions
   • Investigate and implement measures to prevent secondary damage and recurrence in the event of data incident

   If any personal data incident occurs, we will take appropriate remedial actions and notify affected users where required.

9. Your rights

   We recognize you have rights to your data including rights to know, access, correct, transfer, restrict the processing of, and deletion of your personal data. We shall faithfully and appropriately deal with your exercise of rights in accordance with the provisions set forth in applicable laws and regulations.

   You can correct a part of your data through the Y-Connect R. If you have any other requests regarding the processing of your data, please contact us through the contact channels provided in the Y-Connect R and in “11. Contact Information”.

   Please note that we are required to hold some/all of your data to fulfill obligations under applicable laws and regulations. Additionally, we may need some/all of your data to provide related services you have registered for and may not be able to respond to your request.

   If you are unsatisfied with our response, you have the right to file a complaint with the relevant responsible data protection authority in your country or region in accordance with applicable laws and regulations.

   You may request deletion of your account and personal data, subject to lawful retention requirements and technical limitations. Upon receiving a verifiable request, we will delete or anonymize such personal data within a reasonable period unless retention is legally required.

10. Change to this Application Policy

    We may amend, revise, add to, or delete the contents of this Application Policy due to changes to the specifications of the Y-Connect R and/or required by amendment to applicable laws and regulations. Changes to this Application Policy will be notified to you through Y-Connect R when it causes a significant impact on your rights and freedoms.

    Continued use of Y-Connect R after such changes will be treated as acceptance of the updated version.
